These Terms and Conditions are effective from 19.04.2023. All previous terms and conditions are no longer valid and must not be relied upon.

These Terms and Conditions (hereinafter referred to as "T&Cs") regulate the usage of the games provided through www.bigwins.com, as well as other URLs licensed to or belonging to EastPoint Operations B.V. These T&Cs, the Privacy Policy and Cookies Policy, the Game Rules and any document expressly referred to in them, as well as any guidelines, rules or similar displayed on the Website constitute the agreement and understanding between the Parties and govern the contractual relationship between EastPoint Operations B.V and the End Users. You are responsible for reading these T&Cs carefully and making sure you understand them. Should you not agree with these T&Cs you should refrain from using the Website any further.

  1. General

    1. EastPoint Operations B.V. is a company incorporated under the laws of Curaçao with company registration number 160230, and having its registered address at Emancipatie Boulevard, Dominico F. ‘Don’ Martina 31, Willemstad, Curaçao.

    2. EastPoint Operations B.V. is here referred to as "Big Wins", “Company”, "We", "Us" or "Our" and the user and registered End user shall be referred to as "You", "Yours", "User", "End user" or "the user", as and where appropriate.

    3. www.bigwins.com is operated by EastPoint Operations B.V., registered in the Commercial Register of Curaçao under number 160230 and address Emancipatie Boulevard, Dominico F. ‘Don’ Martina 31, Willemstad, Curaçao.

    4. EastPoint Operations B.V. is duly licensed through a sublicense granted by C.I.L. Curaçao Interactive Licensing N.V., pursuant to Master Gaming Licence #5536/JAZ issued by the Governor of Curaçao.

    5. These Terms and Conditions may be presented in various languages other than English for reference only. In the event of any differences or conflict between the English version of the Terms and Conditions (accessible from the homepage of the Website) and a version in any other language, the English version shall prevail.

    6. You must read these Terms and Conditions carefully in their entirety before creating an account. If you do not agree with any provision of these Terms and Conditions, you must not create an account or continue to use the Website.

    7. Big Wins reserves the right to change these Terms of Use from time to time for a variety of reasons, including compliance with applicable laws, regulations and other regulatory requirements. Therefore, we may revise this Agreement between you and Big Wins at any time. If the terms of use are significantly revised, we will notify you on the website at the time of login. If you do not agree to be bound by the revised Terms of Service and wish to close your account and withdraw your valid account balance, you must contact customer support. Please refer to the version number and update date listed at the top of these Terms of Use to see if there have been any changes to these Terms of Use.

    8. These T&Cs come into effect by confirming your registration details in the registration process on the Website. By registering an account with Big Wins, you agree that you have read, understood and accepted these T&Cs.

  2. Obligations, requirements and responsibilities

    By agreeing to be bound by these Terms and Conditions, you also agree to be bound by the Big Wins Rules and Privacy Policy that are hereby incorporated by reference into these Terms and Conditions. In the event of any inconsistency, these Terms and Conditions will prevail.

    You hereby represent and warrant below.

    1. You are over (a) 18 or (b) such other legal age or age of majority as determined by any laws which are applicable to you, whichever age is greater.

    2. Gambling is illegal unless you are of legal age. If we cannot confirm that you are of legal age, we will freeze your user account. If it is determined that the age at which you were gambling or trading is not legal age:
      - The user account will be closed.
      - All transactions made when you are under the legal age and all related funds deposited will be invalid.
      - All stakes made when you are under the legal age will be void.
      - The prize money won at that time will be deprived and the funds withdrawn from the user account will be refunded to the operator.

    3. Only one account can be opened on this website. To ensure adherence to this policy, we utilize a variety of methods, including but not limited to monitoring household addresses, IP addresses, emails, phone numbers, and payment methods, to identify potential overlaps among individual or group accounts. Regardless of the reason, if a user opens or attempts to open multiple accounts, betting on duplicate accounts will be invalidated at our discretion. We may block or close any or all of your accounts. Other opened accounts are considered "multiple accounts". If you open multiple accounts, all the accounts you have opened will be closed immediately from this site. Also,
      - All transactions used by your account or multiple accounts will be invalid.
      - All stakes and deposits made on your account or multiple accounts will be void.
      - Profit, winnings, and bonuses earned while using multiple accounts will be deprived of you and confiscated by us. In addition, we may ask you to refund the funds withdrawn from your account or multiple accounts to this site upon request.

    4. You must immediately notify us if you notice that you have more than one registered Account. Failure to do so may lead to your Account being blocked and funds confiscated.

    5. As an End user you are responsible for providing Big Wins with correct personal details. Consequently, you agree that all information that you give us, such as but not limited to, valid identification, address and email, during the term of validity of this agreement, is complete and true, and that you shall immediately notify us should there be changes to such information. Should Big Wins become aware that you have deliberately failed to provide us with correct information, we retain the right to block the account and confiscate any funds therein.

    6. You are solely responsible for your account information and / or other ways of accessing your account through the website. If you suspect that your account has been compromised, you should immediately contact us and take appropriate steps to prevent unauthorized access to your account and your account balance.

    7. You participate in the Games strictly in your personal and non-professional capacity; and participate for recreational and entertainment purposes only.

    8. You participate in the Games and make bets on your own behalf and not on the behalf of any other person.

    9. You understand that by using our services you take the risk of losing money deposited into your Member Account and accept that you are fully and solely responsible for any such loss

    10. You are not allowed to transfer funds from your account to another user's account, or to receive money from other users into your account, so called buddy transfers. Big Wins accounts are not transferable and it is prohibited for users to sell, transfer or acquire accounts from other users.

    11. You may participate in any Game provided on our Website/s only if you have enough funds on your account for such participation.

    12. You may not use funds that are tainted or associated with any illegality and, in particular, you may not use funds that originate from any illegal activity or source. We moreover reserve the right to terminate an account, ban a user and retain all funds where that user is reasonably suspected of engaging in fraudulent activities which include, but are not limited to: the use of stolen or falsified credit cards or account numbers, chip dumping, forgery, collusion, and the submission of data or documents which are forged, stolen or otherwise misappropriated or tampered with. You may be required to evidence the source of your funds as part of Big Wins's KYC procedures.

    13. With regards to deposits and withdrawals of funds into and from your Account, you acknowledge that you shall only use such credit cards and other financial instruments that are valid and issued by lawful institutions and that legally belong to you solely. The use of financial instruments whose ownership is shared with other individuals, is not tolerated and will result in voiding of winnings.

    14. It is your sole responsibility to abide by any reporting processes related to the payment of taxes and/or other fees which might be charged on winnings that you receive from Big Wins, if and where applicable in your jurisdiction. Big Wins shall not be held responsible for your failure to make payment of any taxes due by you to relevant authorities and shall be in no position to advise you of the same.

    15. You declare that you are not and shall not be involved in any fraudulent, collusive, fixing or other unlawful activity in relation to the participation in any of the Games and that you shall not use any software-assisted methods or techniques or hardware devices for your participation in any of the Games. We hereby reserve the right to void any wagers and confiscate any funds, should we suspect such behaviour.

    16. You accept and acknowledge that we reserve the right to detect and prevent the use of prohibited techniques, including but not limited to fraudulent transaction detection, automated registration and signup, gameplay and screen capture techniques. These steps may include, but are not limited to, examination of users device properties, detection of geo-location and IP masking, transactions and blockchain analysis. We hereby reserve the right to void any wagers and confiscate any funds, should we suspect such behaviour.

    17. You are solely responsible for reporting and accounting for any taxes applicable to you under relevant laws for any winnings that you receive from us.

    18. You understand that Crypto currency is not considered a legal currency or tender and as such on the Website they are treated as virtual funds with no intrinsic value.

    19. You have full capacity to enter into a legally binding agreement with us and you are not restricted by any form of limited legal capacity.

    20. You are not diagnosed or classified as a compulsive or problem gambler. We are not accountable if such problem gambling arises whilst using our services, but will endeavour to inform of relevant assistance available. We reserve the right to implement ‘’cool off’’ periods if we believe such actions will be of benefit.

    21. You affirm that you are not an officer, director, employee, consultant or agent of Big Wins or working for any company related to Big Wins, or a relative or spouse of any of the foregoing.

    22. By participating in our BigWins Casino, you understand and accept that refunds will not be issued under any circumstances. All transactions, deposits, and wagers are considered final. We encourage you to manage your account balance responsibly and be mindful of the risks associated with online gambling. Enjoy your gaming experience and play within your means.
    23. You are aware that the right to access and use the Website/s and any products there offered, may be considered illegal in certain countries. Consequently, you are responsible in determining whether your accessing and using our website is compliant with the applicable laws in your country and you warrant to us that gambling is not illegal in the territory where you reside.     24. Big Wins reserve the right to conduct such checks at any time as we deem necessary to verify our compliance with clause 2.22.

    25. If a user tries to get around the website's restrictions by providing false information about themselves, or making a bet on behalf of someone else in a prohibited area, they are violating the website's Terms of Use. Such behavior may result in account closure without prior notice if there is a reasonable suspicion that the user is accessing the website from a restricted area.

    26. You will not use our services while located in any jurisdiction that prohibits the placing and/or accepting of bets denominated in Crypto Currency online, and/or playing casino and/or live games for and/or with Crypto Currency.

    27. You accept our right to terminate and/or change any games or events being offered on the Website, and to refuse and/or limit bets.

    28. You shall be courteous to other users using the Websites, as well as support personnel and other staff employed by Big Wins and avoid rude or obscene comments. This includes behaviour or language that may cause staff to feel afraid, intimidated, threatened or abused, e.g. the use of language that could be described as foul, offensive, inappropriate and/or racist, threats or physical violence, derogatory remarks, rudeness, harassment, inflammatory statements and unsubstantiated allegations. This also includes unreasonably persistent customers who, because of the frequency or nature of their contact, place a strain on time and resources, e.g. pursuing complaints in inappropriate ways, pursuing issues that appear to have no substance, or which have already been investigated and the outcome determined. Any non-observance of this clause and of the game rules shall not be tolerated under any circumstance. Such cases may lead to the closure of your account and/or restricted access to our Support Team. There are a range of ways that the company may restrict access, and the action applied will depend on the nature of the behaviour. These include but are not limited to: restricting contact to one method (e.g. email only) or only acknowledging further correspondence where new and pertinent information is presented which has not been previously considered, refusing to accept further communications, restricting the issues we will correspond on or terminating all contact with the company.

    29. You must not use the casino as a means of making a living or generating income. Any player who is found to be engaging in professional play will have their account terminated, and any winnings will be forfeited.

    30. The casino reserves the right to ban or terminate the accounts of any player who is found to be engaging in professional play or attempting to exploit the system. The casino will investigate any suspicious activity and take appropriate action to protect the integrity of the platform.
    31. These Terms and Conditions shall be governed by the Laws of Curacao. Any disputes arising out of these Terms and Conditions shall be determined by courts of law in Curacao.

  3. Account and verifications

    1. In order to place a bet or make a deposit on this website, the user must first open an account (“account”) personally. In order to actually play the games provided by our company using real money, you must register on this website. Big Wins reserves the right, in its sole discretion, to refuse to register or open an account.

    2. Each Player may only have one Player Account. Violation of this rule may result in the closure of all the Player Accounts registered by the Player and the Company shall only pay back that which remains of the deposits made by the Player.

    3. Keeping your login information secure is your sole responsibility. Users should never disclose their login information to anyone. We are not responsible for any misuse or misuse of your account by a third party, whether intentionally or accidentally, actively or passively, due to the disclosure of your login information to a third party. Activities performed using the user's login information are considered to have been performed by the user himself, and all liability arising from such activities shall be the responsibility of the user. In the unlikely event that a third party knows your login information, it is your responsibility to notify us and change your login information.

    4. Users can log in to their account at any time to view their account history such as deposits, bonus credits, winnings, stakes and withdrawals. If you become aware of an error, you should immediately report it to Big Wins so that you can investigate and correct it as needed.

    5. We reserve the right to verify your identity and request you to submit relevant documents at any time for any reason. This includes, but is not limited to, background checks, credit checks, or legally permitted personal history checks: The criteria for these investigations will vary from case to case, but will confirm the user's registration information such as name, address, age, occupation, the user's financial status, the confirmation of the user's financial transactions such as funding sources, and / or the game.

    6. You agree to provide us with any information we request to assist with our verification checks, and we reserve the right to request documents to verify the following: (i) your identity, such as a valid photographic ID (e.g. a copy of your National Identity Card, Passport or Driving Licence); (ii) your residential address (e.g. copies of bank statements and/or utility bills dated within the last three months); and (iii) proof of ownership/authorisation to use a certain payment method (e.g. a screenshot of the account (i.e. Neteller) that corresponds to the payment method). We may request that you provide any of these documents certified to attest their credibility. We may also use additional verification tools available to us in order to verify the authenticity of any documents you provide. Furthermore, if we have reasonable grounds to believe that any documents provided by you are not genuine or are inaccurate, we reserve the right to refuse such documents. Big Wins reserves the right to restrict any account until the relevant verification checks have been carried out to our reasonable satisfaction, and to the standard required of us under applicable laws and regulations. Big Wins further reserves the right to close your account and return any remaining balance if verification checks have not been carried out to our reasonable satisfaction within thirty (30) calendar days from our first request for documents.

    7. Big Wins has no obligation to inform you that such an investigation is being conducted. These investigations may include the use of authorized credit referral agencies, identity verification services to verify the identity of users, and / or the use of certain third-party companies conducting investigations such as fraud prevention agencies. Big Wins may, in its sole discretion, close your account and withhold all balances if the results of these investigations are negative or uncertain. All personal information will be processed in accordance with our privacy policy.

    8. Big Wins, in our sole discretion, does not provide any explanation if we consider that continuing our business relationship with you may adversely affect our licenses and general regulatory obligations or any of our services. Refuses to open a personal account or reserves the right to freeze or close an account at any time. However, the contractual obligations already made by Big Wins shall be adhered to without prejudice to the right to use Big Wins by law.

    9. Big Wins has the right to appoint payment solution providers to act, receive and/or pay funds on its behalf.

    10. If credits, winnings or other funds are accidentally deposited into your account, you must immediately report to Big Wins via email or chat. Accidentally deposited amounts are, without exception, the property of Big Wins, and the user must immediately refund the applicable amount from his account to Big Wins. If you withdraw funds that have been accidentally deposited, you will be considered a clearing debtor to Big Wins with the withdrawal amount that needs to be repaid immediately. If you place a bet using accidentally deposited credits, winnings or other funds, all of these bets will be void.

    11. No interest will be paid on your balance, regardless of the amount in your account balance. Therefore, the user shall never treat Big Wins as a financial institution.

    12. All communication between the End user and Big Wins is kept on record for compliance, as well as accounting and financial regulations' purposes. In the case a user account is closed, any information about the account is saved for up to five (5) years, or longer if stipulated by law, from the time the account is closed, or as otherwise indicated within Big Wins's data retention policy on the basis of applicable laws.

    13. Big Wins does not provide services to users who are considered to be persons (PEPs) who hold important positions in domestic and foreign governments. If at any stage it is determined to be PEPs, the user's account will be closed. If you disagree with our decision as PEPs, please contact us by email or chat.

    14. Our calculations of your Account Balance, Bonus Balance and amounts owed by you under these Terms and Conditions will be final and, in the absence of any manifest error, will not be subject to amendment based on enquiry, external auditing or investigation.

    15. We reserve the right to suspend user accounts that have been inactive for more than 12 months.  If your account has been suspended, please contact [email protected] for instructions on how to reactivate your account.

    16. If you want to recover funds from your account after it has been closed, blocked, terminated, or excluded, you may do so by email at [email protected].

    17. You are not permitted to transfer, sell and/or acquire accounts to / from other Users. If we have reasonable grounds to believe such activity has occurred, we reserve the right to suspend and/or close the account in question.

  4. Deposits & Withdrawals

    1. You may make deposits in crypto or fiat currency. The minimum deposit amount for the selected method/currency is specified on the deposit page. The minimum deposit amount for all methods and currencies can be found on our FAQ page. All minimum deposit amounts specified are per single transaction. Smaller deposits will not be summed. Sending any amount below the minimum will result in funds loss and is not refundable. Big Wins shall not be held liable if deposits do not meet our minimum deposit requirements.

    2. We accept Bitcoin (BTC), Bitcoin Cash (BCH), Ethereum (ETH), USDT, XRP, TRX and other Crypto Currencies as well as Fiat currencies.

    3. Big Wins cannot guarantee that all currencies will be natively supported in games. Some games may reflect available balance in a different currency.

    4. To deposit funds into your Member Account, you can transfer funds from crypto-wallets and credit cards and accounts (bank, eWallet etc.) under your control, deposits can only be made with your own funds.

    5. If you make a deposit with a credit card or debit card, at our reasonable discretion, we might ask you to submit a double-sided image of the used card that allows you to confirm the first 6 digits and the last 4 digits of the relevant card number, excluding the security code (CVV, etc.).

    6. If you make a deposit with a credit card or debit card, we reserve the right to process all withdrawal requests up to the total amount of deposits as refunds, against the purchases made. If you’ve withdrawn more funds than what you have deposited, we may pay out any additional amounts via another payment option.

    7. The full credit/ debit card information is never stored by Big Wins and always transmitted in an encrypted way for your security.

    8. We do not extend credit for the use of our services.

    9. All withdrawals shall be processed in accordance with our withdrawal policy.

    10. Where possible, all withdrawals will be processed to the payment account from which the deposits were made. Withdrawal payments can only be made in the name of and to the registered account holder.

    11. Crypto currency withdrawals will be made to your stated Crypto currency wallet address when making a valid withdrawal request. To withdraw any funds which have been deposited, we require there to be at least 3 blockchain confirmations of the deposit before a withdrawal can be approved.

    12. The minimum fiat currency withdrawal amount is €20 (or an equivalent in alternative fiat or crypto currency). Fiat currency withdrawal may take up to 3-5 working days from the moment they are approved depending on the payment service provider. If you apply for withdrawal below the minimum withdrawal amount, Big Wins will incur a 5 EUR fee.

    13. In the event of a large withdrawal request, we may elect to process no more than 10 BTC per week until the full amount is settled.

    14. For fiat deposits and withdrawals to your account, you agree to use only valid credit cards and other payment methods issued by a legitimate institution and in your name. We reserve the right to close your account and invalidate all winnings if we determine that the name of your payment method is not yours or we have reasonable grounds. Big Wins prohibits the use of cards issued to businesses.

    15. Upon your first deposit and throughout the lifetime of your account, we reserve the right to use additional procedures and means to verify your identity when processing deposits and/or withdrawals into/from your Member Account. Verification will involve personal identity documents. We may also require an additional document confirming ownership of your payment instrument and address as well as part of the verification process. Such documents include but are not limited to passports, utility bills, bank statements, copies of credit card statements, copies of payment method statements such as credit cards and various e-Wallets, and documents certifying the source of funding.

    16. All deposits made by players, unless otherwise specified, are subject to a wagering requirement. This requirement must be met before any winnings or remaining deposit funds can be withdrawn from the player's account.

    17. The wagering requirement for deposits is that the deposited amount must be wagered at least one time (1x) on casino games, excluding any bonus funds. For example, if a player deposits EUR 100, they must wager a total of EUR 100 in the casino before they can request a withdrawal.

    18. We reserve the right to withhold any withdrawal request if the wagering requirement for deposits has not been met.
    19. Different games may contribute different percentages towards meeting the wagering requirement. The following is a list of game contribution percentages:

      a. Slots: 100%
      b. Table Games: 15%
      c. Live Casino Games: 15%
      e. Other games: 100%

    20. Сertain games may be excluded from contributing to the wagering requirement. These excluded games will be listed on the casino's website or within the specific promotion's terms and conditions.

    21. If a player requests a withdrawal before meeting the wagering requirement for their deposit, the casino reserves the right to void any winnings generated from that deposit.

    22. BigWins Casino reserves the right to change or update the wagering requirement for deposits at any time. It is the player's responsibility to review the terms and conditions regularly to stay informed about any changes.
    23. We reserve the right to apply a wagering requirement for Crypto Currency deposits of at least 5 (five) times the deposit amount if we suspect the user in using our service as a mixer. It is strictly forbidden to use our service for any other purpose than entertainment.

    24. For withdrawals, Big Wins reserves the right to require 100% wagering of the last deposit amount prior to accepting a withdrawal request. In cases where this condition is not met, Big Wins reserves the right to charge a processing fee. The processing fee will be either the payment processing costs associated with the initial deposit and withdrawal or 30% of the withdrawal amount, whichever is higher, under all circumstances.

    25. Players found to be abusing the wagering requirement system or attempting to withdraw funds without meeting the wagering requirements may have their accounts suspended or terminated, and any winnings or remaining deposit funds.
    26. Bonus funds may be credited to your account as part of a campaign, loyalty program, or other marketing campaign. These bonuses must be used for betting on the website and cannot be withdrawn as is. Depending on the campaign, these bonuses may be redeemed for real money if the conditions are met in accordance with the specific terms and conditions of each campaign. Please refer to each campaign terms and conditions for details.

    27. Note that some payment methods may include an additional fee. In this case, the fee will be clearly visible for you in the cashier.

    28. Note that your bank or payment service provider may charge you additional fees for deposits, withdrawals of currency conversion according to their terms and conditions and your user agreement.

    29. Big Wins reserves the right to apply a handling charge of up to 5% on deposits and withdrawals to cover transaction costs.

    30. Should your account become overdrawn due to a duplicate payment error, for example, if a withdrawal request being processed twice for whatever reason, you agree to fully reimburse Big Wins for any such overdrawn amounts.

  5. Responsible Gambling

    1. Big Wins offers a range of services to assist you if you are, or think you are, developing a dependency towards gambling. We have in place a series of measures, which will help you play in a safe environment. You understand that when you are playing games of chance that involve money, the outcome can never be sure. We have developed tools that will make your gaming experience safer. In order to use these tools, you must clearly state your preferences by contacting our customer support service via email at [email protected] or by contacting us via live chat, or by using the several tools available on the Website to indicate your preference. We encourage you to consider these measures when playing on Big Wins Website.

    2. You may, at your discretion, ask us at any time to exclude you from placing any transactions on the Website for a specific time period. You can do this online, by visiting the Limits section of your account, or by contacting Customer Services. In asking us to exclude you, you acknowledge and agree that we will suspend your account and prevent you from gambling on the Website for the time period requested. Applying a self-exclusion will not affect any pending withdrawal, unless verification documents are requested in line with our KYC process.

    3. Self-Exclusion

      1. Should you opt to self-exclude, we will take all reasonable steps to detect and prevent you from registering a new account on the Website. You should not attempt to open a new account with Big Wins whilst you have opted for self-exclusion. Any accounts found to be in breach of a self-exclusion agreement will be closed as soon as such use is discovered.

      2. Please understand that it is important for us to be made aware as to the motive for your exclusion, especially if this is related to problem gambling matters. Kindly inform us as to this reason upon making your closure request.

      3. We shall have no responsibility or liability to you or any third party for any gambling activity that takes place (including to refund any losses) if you circumvent our self-exclusion procedures by fraudulent means or by deliberately entering incorrect information.

    4. Time-Out. You may temporarily take a break from gambling on the Website (twenty four (24) hours minimum). You can do so online by visiting the Limits section of your account. On confirming the Time Out, your account will be immediately suspended and it will not be possible to log in until the selected duration has expired.

    5. Limits

      You may at your discretion choose to set limits on your account. You may:
